XRP (Ripple) has emerged as a key case that established a benchmark for the cryptocurrency regulatory framework after years of litigation.
According to cryptocurrency media Watcher.Guru on April 29 (local time), the legal nature of XRP became clear after the lawsuit between the U.S. Securities and Exchange Commission (SEC) and Ripple ended, and it is evaluated to have played a decisive role in building the overall virtual asset regulatory framework.
The U.S. court ruled that the sale of XRP to individual investors does not constitute a security, but its sale to institutional investors is considered a security. This judgment resolved the asset classification issue, which was the biggest uncertainty for investors, leading to a recovery of market confidence, and XRP recorded an all-time high of $3.65 in July 2025.
Since then, the regulatory environment has also been rapidly clarifying. The SEC and the U.S. Commodity Futures Trading Commission (CFTC) jointly announced in March of this year that most cryptocurrencies are classified as digital commodities rather than securities. Accordingly, a direction was proposed for major assets such as Bitcoin (BTC), Ethereum (ETH), and XRP to be brought under CFTC jurisdiction.
Concurrently, the launch of an XRP spot ETF at the end of 2025 marked the full-scale integration into the institutional framework. However, since this product is subject to securities law, it will continue to operate under SEC supervision. This is considered an example where the same asset is subject to different regulatory frameworks depending on the type of investor.
In the U.S. Congress, the passage of the U.S. Crypto Market Structure Bill, the CLARITY Act, is imminent. The Senate is expected to pass it by May 2026, which will further specify the current structure where assets like XRP are classified as non-securities for individual investors and securities for institutions.
